Section 1Agreement and eligibility

These Terms of Use and Sale (the “Terms”) govern your use of evolutionpinball.com and any purchase, pre-order, quote, or related transaction you place with Evolution Pinball through the website, by phone, or through written communication. By using the site or submitting an order, you agree to these Terms.

You may place an order only if you have the legal capacity to enter into a binding agreement. If you act for a business, organization, or another person, you represent that you have authority to bind that party and permission to use the payment method and delivery information supplied.

Section 2Site information and availability

We work to keep product names, editions, prices, specifications, photographs, availability, and other website information accurate. Pinball manufacturers may revise specifications, artwork, included accessories, production schedules, or availability, and screen colors may not exactly match a finished machine.

A product listing does not guarantee that a machine or edition remains available. We may correct typographical, pricing, technical, or inventory errors. If a material error affects an order before acceptance, we will contact you with the corrected information so you may confirm the corrected order or cancel it. Any amount collected for a canceled item will be refunded as required by the payment method and applicable law.

Section 3Orders and acceptance

Submitting a checkout request, phone order, deposit, or signed quote is an offer to purchase. An automated receipt only confirms that we received the request; it does not by itself guarantee inventory or acceptance. An order is accepted when Evolution Pinball confirms acceptance in writing or fulfills the order.

We may request reasonable identity, payment, delivery, or fraud-prevention verification. We may decline or cancel an order before fulfillment because of unavailable inventory, a manufacturer allocation change, a material pricing error, suspected fraud, payment failure, delivery restrictions, or another lawful reason. If we cancel after collecting payment, we will refund the amount collected for the canceled item.

Commercial, operator, route, or multi-machine purchases may require a written quote with transaction-specific pricing and delivery terms.

Section 4Pricing, payment, and financing

Prices are stated in U.S. dollars unless the page or quote says otherwise. Shipping, delivery, setup, taxes, payment-provider charges, and optional accessories are included only when they appear in the checkout total or written order documents. Applicable sales tax is calculated from the transaction and delivery information available at the time of purchase.

Available payment methods are displayed at checkout or confirmed in writing. Promotions, discounts, and price protection apply only according to their stated conditions and may not be combined unless we expressly agree.

Financing and pay-over-time products are provided by third parties under their own applications, approvals, rates, repayment schedules, privacy practices, and agreements. Evolution Pinball is not the lender and does not make the provider's credit decision. Review the provider's terms before accepting financing. Section 5Pre-orders and special orders

Pre-orders, manufacturer allocations, limited editions, and specially sourced machines may depend on production schedules and inventory outside Evolution Pinball's direct control. Any deposit, payment schedule, configuration, or order-specific cancellation condition will be stated in the applicable quote or order confirmation.

Production, build-slot, shipment, and delivery dates are estimates unless expressly guaranteed in writing. If we learn that an order cannot ship within the promised time, we will provide a revised estimate and the delay, cancellation, or refund options required by applicable law. Do not schedule contractors, events, travel, or location openings solely around an estimated date.

Section 6Shipping, delivery, and pickup

Available delivery methods, service areas, costs, and included services are shown at checkout or in the written quote. Delivery windows are estimates and may be affected by manufacturers, freight carriers, weather, access restrictions, and appointment availability.

Curbside and freight delivery

Curbside or standard freight service does not include in-home placement, stairs, uncrating, assembly, installation, or packaging removal unless the written order says it does.

White-glove or in-home service

The exact placement, assembly, setup, stair, and packaging services included in white-glove or in-home delivery are limited to the scope written in the order confirmation. Tell us about stairs, narrow doors, elevators, restricted driveways, loading limitations, and other access conditions before delivery is arranged.

Customer responsibilities

• Provide a complete delivery address, working phone number, and an authorized adult recipient.
• Confirm that doors, halls, stairs, elevators, flooring, and the final room can safely accommodate the machine and delivery method.
• Keep the delivery route clear and provide any building approvals or access reservations.
• For pickup, arrive at the confirmed time with a suitable vehicle, restraints, and help needed to transport the machine safely.

Documented carrier costs caused by an inaccurate address, undisclosed access restriction, missed appointment, refused delivery, re-delivery, or storage may be the customer's responsibility when permitted by law and the applicable order documents.

Section 7Inspection, damage, and defects

Inspect the carton, pallet, cabinet, glass, and visible components when the machine arrives. Note visible damage on the carrier's delivery record before signing, take clear photographs, keep the packaging, and contact Evolution Pinball promptly. Signing without a damage notation can make a freight claim more difficult, although it does not remove rights that cannot be waived.

Report concealed damage, missing parts, or a suspected defect promptly after discovery. Do not discard packaging or attempt a repair that may be unsafe or affect a manufacturer claim. We will help identify the appropriate carrier, manufacturer, parts, or service path based on the order and the issue.

Section 8Cancellations, returns, and refunds

Pinball machines are large, high-value goods that may be manufacturer-allocated, specially ordered, configured, or shipped by freight. A cancellation or return is not automatically approved. Contact Evolution Pinball as soon as possible and before shipping anything back. See our dedicated Returns, Cancellations, and Refunds policy for the request process and contact information.

• A return requires written authorization from Evolution Pinball before shipment.
• Eligibility depends on the item, order status, condition, configuration, manufacturer or distributor commitments, freight status, order-specific terms, and applicable law.
• We will identify any approved return freight, restocking, inspection, or nonrefundable service charge in writing before the return is sent.
• Shipping, delivery, setup, financing, or other completed service charges are refundable only when required by law or the applicable written terms.
• Approved refunds are issued to the original payment method unless another method is required by law or agreed in writing.

Section 9Manufacturer warranties and service

A factory-new machine may include a written warranty from its manufacturer. The manufacturer's current written warranty controls its duration, coverage, claim process, remedies, exclusions, parts, and labor. Evolution Pinball does not expand or replace that warranty unless we expressly agree in writing.

You may contact us before purchase to request the current written manufacturer warranty for a machine. After purchase, keep the invoice, serial information, packaging, and manufacturer materials. We provide post-sale guidance and can help route a claim, but the manufacturer determines coverage under its warranty.

Any warranty or service commitment for a used, classic, consigned, display, or otherwise non-new machine is limited to what the product listing or order confirmation expressly states. Product condition should be reviewed before purchase.

Section 10Affiliate links and third-party services

Some pages contain affiliate links. As an Amazon Associate, Evolution Pinball earns from qualifying purchases. An affiliate commission does not increase the price you pay to Evolution Pinball, and the third-party seller - not Evolution Pinball - controls its listing, inventory, transaction, shipping, returns, warranty, privacy practices, and customer service.

Payment processors, financing providers, carriers, maps, videos, social platforms, and other third-party services operate under their own terms and privacy practices. A link or embedded service does not make Evolution Pinball responsible for that third party's content or conduct.

Section 11Intellectual property

The Evolution Pinball name, site design, original text, graphics, photographs, editorial features, and other original site material are owned by or licensed to Evolution Pinball and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal, noncommercial use, but may not reproduce, republish, sell, or commercially exploit site material without permission.

Pinball titles, manufacturer names, character names, logos, artwork, videos, and other third-party materials belong to their respective owners. Their appearance identifies or describes products and does not transfer ownership to Evolution Pinball.

Section 12Acceptable use

You may not use the site to violate law, impersonate another person, submit false order or payment information, introduce malicious code, probe or bypass security, interfere with site operation, misuse forms, or use automated requests in a way that burdens the site or copies protected content. We may restrict access or cancel affected requests when reasonably necessary to protect customers, the site, or the business.

Section 13Information and communications

Forms, quotes, checkout, delivery, and support requests may require contact, order, payment, and delivery information. That information may be handled by payment processors, financing providers, manufacturers, distributors, carriers, and service providers when needed to complete the requested transaction or support.

By providing a phone number or email address, you authorize transaction-related communications about an inquiry, order, delivery, warranty, or support request. Marketing messages remain subject to your choices and applicable law. Do not submit payment-card numbers, account credentials, medical information, or other unnecessary sensitive information through the general contact form.

Section 14Disclaimers and liability

The website and its general informational content are provided on an “as available” basis. We do not promise that every page will always be uninterrupted, error-free, or current to the minute. This website disclaimer does not alter a written manufacturer warranty, accepted order term, or consumer protection that cannot lawfully be waived.

To the fullest extent permitted by law, Evolution Pinball is not liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the website. Liability connected to a purchase remains subject to the accepted order documents and applicable law. These limitations do not apply where prohibited or to liability that cannot legally be limited.

Section 15Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where another jurisdiction's mandatory consumer law applies. Nothing in these Terms removes a consumer protection, remedy, or venue right that cannot be waived.

Before filing a dispute, please contact us with the order or issue details so the parties have a reasonable opportunity to resolve it directly.

Section 16Changes to these Terms

We may revise these Terms when the site, services, business practices, or legal requirements change. The effective date at the top identifies the current version. Revised Terms apply prospectively when posted. An accepted order remains governed by the version and transaction-specific documents applicable when it was accepted, unless the parties agree otherwise or law requires a different result.
